$8 Million Settlement – Montgomery County
Our client, a minor, rear seat passenger received a settlement award as a result of neurological injuries suffered in a motor vehicle accident wherein the Defendant was operating a commercial vehicle and intentionally/recklessly collided with the minor’s vehicle after a road rage incident. A portion of the settlement funds were utilized to purchase an annuity which could provide lifetime benefits over $35 million.
$3.5 Million Settlement – New Jersey – Burlington County
Our clients, a medical doctor and his wife, were involved in a motor vehicle accident on Route 73 in Cinnaminson, NJ. They were stopped at a red light when they were violently rear-ended by a tractor-trailer. As a result, the husband suffered injury to his shoulders requiring bilateral surgery. His wife suffered significant injuries to her neck and lower back. After extensive litigation, Stampone O’Brien Dilsheimer Holloway was able to secure a $3.5M settlement in advance of trial.

Bicycle Accident – A Philadelphia jury awarded $3 million to our client, who was a bicyclist struck by an armored

Our client, a Good Samaritan, had stopped his vehicle on the Northeast extension of the Pennsylvania Turnpike to render aide to the victim of a 2-car collision. While rendering aide, our client’s vehicle was struck by a tractor trailer causing our client’s vehicle to strike our client propelling him 30 feet in the air and suffering disabling injuries. Our firm was able to prove that the driver of the tractor trailer was operating the vehicle significantly in excess of the speed limit as a result of expert analysis of the truck’s event data recorder (black box).

Our client received a policy limits award after the amputation of portions of both legs when he was struck by an automobile as he stood on the shoulder of the Atlantic City Expressway. Defendant, a doctor, fell asleep at the wheel.

Our client, a 29-year old mechanic, was involved in a fatal motorcycle accident with a motor vehicle which was exiting a tavern. Through the investigation of an accident reconstructionist, our firm was able to obtain policy limits settlements from both the driver of the motor vehicle, as well as an illegally parked truck, which obstructed the site of both our client and the motor vehicle exiting the tavern. Additionally, our firm was able to obtain a significant settlement from the tavern by proving their parking lot failed to properly designate and control traffic patterns.
$850,000 Settlement – Lehigh County
Our client, a delivery driver, was rear-ended while traveling on the PA Turnpike resulting in permanent injuries to his head and back. Attorney JB Dilsheimer negotiated an $850,000 settlement.
$825,000 Settlement – Philadelphia County
Our client was a passenger in a motor vehicle owned by the Pennsylvania Department of Transportation and was in the course and scope of his employment as a highway maintenance worker with PENNDOT when he was struck in the rear while on the Pennsylvania Turnpike. The settlement included a significant portion of the recovery to compensate him for his loss of wages as a PENNDOT highway maintenance worker.
$825,000 Settlement
Our client was a passenger in a vehicle being operated by a co-employee in the course and scope of his employment when he was struck in the rear, suffering disabling injuries. Our firm was able to obtain an award at binding arbitration in the amount of $825,000.00, as well as a resolution of his underlying workers’ compensation claim in the amount of an additional $50,000.00.

Our client was struck and run over by a tow truck while legally crossing a Southwest Philadelphia street within the crosswalk. As a result, she suffered fractures to her left ankle, tibia, and fibula requiring surgical repair. After filing a lawsuit but prior to trial, our attorneys were able to negotiate a $775,000 settlement with Defendant’s insurance company who has a reputation for vigorously defending claims. Additionally, we were able to obtain Social Security Disability benefits for our client that included a past due benefits payment in excess of $17,000 and ongoing monthly payments of $1,279.
$750,000 Settlement – Montgomery County
Two car motor vehicle accident wherein our client struck her face on the windshield upon impact. Our client suffered injuries to her left cheek, chin and lip, requiring three plastic surgeries for scar repair.

Our client was killed as a result of a collision with a tractor trailer and received a settlement award in a disputed liability contest. The collision occurred after our client lost control of her vehicle and crossed the center line where she was struck by an oncoming truck. The driver of the truck failed to have the vehicle under control in an emergency situation.

Our client was the driver of a delivery vehicle involved in a 2-car collision. He suffered injuries which significantly exceeded the limits of the other drivers’ insurance policies. The commercial vehicle which our client was operating maintained underinsured motorist limits of $1 million dollars. We were able to obtain a settlement of $675,000.00 from the underinsured motorist carrier.

Motorcycle Accident – Our client, who was a novice motorcycle operator, recovered $525,000 as a result of a collision with a Montgomery County police cruiser who violated a stop sign. At the time of the accident, the cruiser was being operated by a trainee police officer. Our client recovered $500,000 which is the maximum allowable under Pennsylvania Law from political subdivision.

Our client was driving a tractor trailer for work when he was cut off by another driver with limited insurance and suffered serious, permanent injuries. Despite our client driving in the wrong lane of travel just before the accident, which resulted in liability being contested by the insurance carriers, our attorneys were able to negotiate a $500,000 settlement.

Our client, a truck driver, lawfully parked his truck and walked to the rear of the truck to obtain his tools. He was then caused to slip and fall on an icy condition within the parking lot owned by his employer’s customer. As a result, he required knee surgery.

Our client was struck and killed by a drunk driver leaving a bar in Philadelphia, PA. Despite limited evidence, our attorneys were able to prove the bar served the driver while they were visibly intoxicated, in violation of liquor liability laws. Next, we obtained video footage of the accident and retained a specialist in forensics and neuropathology to demonstrate the conscious pain and suffering our client experienced prior to their unfortunate death.

Our client was run over while operating her motorized wheelchair in a McDonald’s parking lot. The offending motorist tendered their full insurance policy limits ($300,000) without the need for a lawsuit.
$284,000 Settlement – Salem County, NJ
Our client, a passenger in a vehicle riding on the rural roads of Salem County, NJ was struck by an uninsured, unregistered vehicle operated by a driver with a suspended license. Due to the collision, our client suffered life-threating injuries requiring multiple surgeries. After extensive litigation which included an interpleader action, attorney Tyler Stampone negotiated a $284,000 policy limits settlement.
$265,000 Settlement – Bucks County
Our client was involved in a rear-end motor vehicle accident while waiting to make a left hand turn into his home. Our client, a physically fit personal trainer, required two back surgeries in order to treat herniated discs in his lumbar spine. Our firm was able to obtain policy limits settlements from both the negligent party, as well as his underinsured motorist carrier. The case was complicated by the fact our client was covered by a limited tort policy.

Our client, a 76-year-old woman, was struck head on by a driver who had fallen asleep behind the wheel. As a result, our client sustained fractures to her ribs, pelvis, and spine, which fortunately did not require surgery. Andrea Sasso was able to obtain the $250,000 policy limits from the other driver without the need for a lawsuit.

Police Chase/Motor Vehicle Accident – Our client was killed in a motor vehicle accident involving a police chase through the City of Philadelphia. Our client received a settlement award after alleging the police department failed to follow established procedures for a high speed chase.

Our client received an arbitration award of $200,000 from the underinsured motorist portion of his automobile insurance policy when he was injured by another motor vehicle which only maintained insurance limits of $15,000.
$200,000 Settlement – Bucks County
Our client, a nurse’s aide, was involved in a motor vehicle accident. The client had a significant history of degenerative back conditions which our firm was able to prove were aggravated by this accident, preventing her from returning to work. The client was covered by a limited tort policy of insurance. The settlement offer before trial was $6,000.00. Just prior to trial, the third party insurance carrier and our client’s underinsured motorist carrier tendered their full policy limits totaling $200,000.00.

Our client suffered serious orthopedic injuries when struck by a motor vehicle while a pedestrian.
$200,000 Settlement – Cumberland County
Our client received a policy limit award when she was killed in an accident wherein she was a passenger in a convertible automobile which lost control, crossed the center line, and struck an oncoming vehicle.

Our client suffers personal injuries which operating a motor vehicle and was run off the road by a phantom vehicle. Our client was compensated under the Uninsured Motorist provisions of his employer’s vehicle which he was operating at the time of the accident. Our client suffered a minor hand injury which became complicated by a series of infections.

Our client, a minor, sustained compound fractures of both ankles and a fractured skull after teenage horseplay. The minor was thrown from the hood of the car when the operator of the vehicle accelerated and then stopped suddenly.

Our client was the operator of a motor vehicle when he was rear-ended on I-95, causing him to spin in the opposite direction and strike a guardrail. Injuries sustained were soft tissue injuries.

Our client was operating his motor vehicle on I-95 when he was rear-ended by a person operating a rental vehicle. He suffered severe injuries to his back and neck requiring fusion surgery.
$125,000 Settlement – New Jersey – Cape May County
Jet-ski Accident – Our client, a minor, received a settlement award of $125,000 after being injured in a collision between two wave runners. Our client was a passenger on one of the wave runners when it was struck in the rear and she was thrown into the water suffering a head injury.

Our client was struck by a motor vehicle while making a left turn. His injuries included a severe right ankle fracture, a fractured phalanx and a lacerated liver.

Our client, a college student, was involved in a significant intersectional collision in which both drivers, and their passengers, claimed they had a green light and therefore had the right of way. As such, the defendant denied liability. At their deposition, attorney Dan Stampone was able to prove the other driver was speeding at the time of the crash and therefore more likely to be found at fault. Attorney Stampone negotiated a $105,000 settlement despite contested liability.

Motorcycle Accident – Our client received a settlement award after his motorcycle collided with the rear of a passenger vehicle which intentionally stopped short in a road rage incident.
$100,000 Settlement – Montgomery County
Our client suffered a partial tear to his rotator cuff in an auto accident in Montgomery County, PA. He treated conservatively for 6 months then took a 1.5-year break before returning for surgery to repair the shoulder. Despite the significant gap in treatment and arguments from Defendant that the procedure was unrelated, our attorneys recovered $100,000 for our injured client.

Our client, a 26-year-old woman, was rear-ended while waiting to make a left-hand turn in Ocean County, NJ. The impact caused injury to her neck which required surgery to this otherwise healthy individual. Attorney Andrea Sasso recovered the $100,000 policy limits from the Defendantdriverwithout the need for litigation.

Our client was injured while sitting in a parked car at a gas station in Camden County, NJ when another driver attempted to flee the station without paying for their gas, striking our client in the process. As a result, our suffered injuries to his neck and back which required cervical facet injections and radio frequency ablations. Attorney Andrea Sasso was able to obtain the $100,000 policy limits from the Defendant.
$100,000 Settlement – Ocean County, NJ
Our client, an avid triathlete, was riding his bike in Long Beach, NJ when he was struck by a car traveling in the opposite direction that attempted to make a left turn in front of him. Our client was knocked off his bike and suffered a fractured right clavicle which prevented him from performing his job as a photographer. Dan Stampone was able to quickly obtain the defendant’s policy limits without having to file a lawsuit.
$3.15 Million Settlement – Bucks County
Our client, a Brazilian national, non-citizen, sustained catastrophic injuries while working as a framer/laborer on a construction site. He was caused to fall one story from an unprotected deck. Witnesses alleged a harness and lanyard were available at the job site for his use and that he walked off the unprotected deck while pulling a chalk line. Plaintiff was able to overcome this evidence and the matter was resolved. Our client was also able to continue to receive partial workers’ compensation indemnity benefits and full medical coverage.
$1,584,950 Settlement – Montgomery County
Our client, a teacher, was injured in the course of scope of her employment when she suffered a fall as a result of negligent construction practices and improper sequencing of construction project work on a college campus. Our client suffered injuries to her lower limb and developed RSD.
$1,225,060 Settlement – Philadelphia County
Our client died after consuming alcohol at two parties, including a fraternity party, at a local Philadelphia university. This was a particularly challenging case as the students withheld information to protect their friends/fraternity and refused to admit they ever had a party that our client attended. Despite their commitment to this story, after extensive discovery consisting of 30+ depositions and over 15 discovery motions, our trial team negotiated a $1,225,060 settlement from the various defendants including the fraternity, and homeowners’ insurance carriers of the non-fraternity students’ parents.
$1 Million Settlement – Philadelphia County
In January 2020, our client, a Temple University employee, was making a work-related delivery in center city Philadelphia when he was caused to trip and fall to the ground due to a cracked and uneven cement sidewalk that had a dangerous number of loose stones scattered thereon. After briefly losing consciousness, he awoke in agonizing pain only to discover he was unable to move his legs. Medical personnel quickly confirmed the worst—a life-altering spinal cord injury. Attorney Dan Stampone immediately traveled to the hospital to meet with and gather facts from our client before rushing to the accident scene to document the defective condition. During his extensive inpatient treatment and beyond, Stampone brought in experts in physical rehabilitation and neurology, including the Chief Medical Officer at Magee Rehabilitation, one of the top facilities in the country. Stampone also worked with a Certified Life Care Planner who, based on the report of our medical experts, opined on the projected cost of the client’s future medical treatment. Thereafter, Stampone successfully recovered the defendant’s $1M policy limits.

Elevator Accident – Our client, a registered nurse, received a settlement award of $1 million when she was injured while a passenger on a hospital elevator which suddenly and without warning dropped numerous floors by way of a “free-fall.” Injuries included polyneuropathy and multiple disc herniations.
Six Figure Confidential Settlement Agreement
A commercial property owner sustained water damage to his property as a result of heavy rains which caused the sewer lines to back up. The client’s property was inundated with raw sewage and water which caused significant damage to multiuse commercial/industrial property. The insurance company claimed that there was no coverage for this type of loss under the policy due to the fact that this was not a flood insurance policy; and because there were more than one source of water, i.e. the backup of drains and sewers as well as surface water.

This significantly increased the value of the case which our attorneys settled for $600,000 following mediation.

Our client, an electrician, was injured when he fell through a hole in an attic while constructing a residential home. Our client suffered a fractured ankle which required surgery.

Our client, an electrician, was in the course and scope of his employment while situated on a ladder and running cable through a ceiling of a classroom, the leg of the ladder fell into a hole in the floor, causing the Plaintiff to fall. Workplace Shooting – Our client received a policy limit award after being shot by a co-employee while in the course and scope of employment. Defendant employer failed to provide adequate security after having notice of the co-employees dangerous propensities.

As a result of the negligent act of the person dressed as the Big Bad Wolf, our client suffered scarring and disfigurement of his right upper extremity. Our recovery was from the defendant’s homeowner’s policy.
$250,000 Jury Verdict – Philadelphia County
A Jury awarded damages to our client who slipped and fell on ice and snow on the sidewalk resulting in severe shoulder injuries requiring surgery.

Our client, a mental health patient, was sexually assaulted by an employee at an assisted living facility. The employee, a mental health technician, was performing a skin check of our client’s legs when the assault occurred. An internal investigation performed by the facility determined the claim was unfounded and the employee was reinstated to full work status. Six months later, the Department of Health discovered a previously unreported incident involving the employee and another patient. Our attorneys successfully argued the technician would have been fired before having the opportunity to assault our client had the facility properly reported, monitored, and investigated the alleged sexual assault of patients by staff.

Our client received an arbitration award of $235,000 as a result of injuries suffered when she was caused to slip and fall at her doctor’s office while exiting a medical transit vehicle. The Plaintiff suffered multiple fractures to her femur.
