Product Liability Attorney

Leading Product Liability Lawyer based in Philadelphia

The National Safety Council reported that in 2021, nearly twelve million people went to emergency rooms across the country because of injuries they received from consumer products. Most of those injured were children between infancy to 4 years old, and the second most injured population is adults over 65.

At Stampone O’Brien Dilsheimer Holloway, our leading product liability attorneys have litigated and won thousands of cases where injuries and even deaths could have been prevented if a defective product hadn’t been made. If you believe you or a loved one have been the victim of a defective product, don’t wait. We’re ready to fight for you and your family today to get you the compensation you deserve.

What Are the Four Major Forms of Product Liability?

We’ve worked with clients in our own backyard and around the country, fighting for them and with them to get the compensation they deserve when a product fails. Most product liability cases fall into four categories, including:

  1. Defect in the Product’s Manufacturing: If something goes wrong in the process of creating a product and that manufacturing defect injures the product’s workers or consumers, we will build a winning manufacturing defect claim.
  2. Defect in the Product’s Design: Products need to be safe or operated safely with the right instructions. If the product’s packaging, design, or component fails and injures someone on the job or a customer at home, it becomes a design defect claim.
  3. Inadequate Warning or Failure to Warn: Products must adequately warn the user about any dangers that could occur if the product is misused. When the product fails to warn someone, and they’re injured or worse, it becomes a failure-to-warn claim.
  4. Warranty Breach: Every product is designed for a specific reason, and you need the right product for your job. When a product fails to do what it claims to do, a breach of warranty occurs. When it causes an injury? That’s when you call us.

If you think you or a loved one has a claim in one of these categories, or you’d like to talk to us about an injury or death that occurred as a result of a faulty product, contact Joe Stampone today.

What Are Some Examples of Products That Could Be in a Product Liability Case?

If it’s a product, it could be in a product liability case, but many people don’t realize the vast category of items that can cause injury or death. Some of the dangerous products that we’ve seen in our products liability cases include:

  • Ladders
  • Machinery / Conveyors / Saws
  • Heavy equipment / Lifts / Cranes
  • Vehicles
  • Children’s toys / Sleeper products
  • Home improvement & power tools
  • Chemicals
  • Pharmaceutical drugs
  • Medical devices
  • Over-the-counter medications
  • Auto parts
  • Lawn & garden equipment
  • Household products
  • Forklifts

Our experience in product liability cases cannot be contained in a bulleted list. If you or a loved one has been hurt or killed because of a product’s defects or a manufacturer’s failure to warn you, we want to hear from you. Give us a call so we can discuss your case.
